How to Check Business Licence Requirements in Hong Kong

Identify the permission needed for the work, place and people behind your business model.

Hong Kong business licence requirements depend on the activities performed and sometimes the premises, personnel, customer market or handling of money. Begin with the government’s Business Licence Information Service, then verify each relevant requirement with the issuing authority. Company incorporation and a Business Registration Certificate do not replace that activity-specific review.

Key takeaways

  • Describe the revenue activity precisely before choosing a licence category.
  • A premises review can change the viability of a lease or fit-out before an application starts.
  • Corporate permission and individual approvals may be separate dependencies.
  • Keep a dated screening record and reopen it when the operating model changes.

Describe what the business will actually sell or do

Write a short operating description before searching for a licence. Include the product or service, how it is supplied, where staff and customers are located, the premises used, and whether your business will hold or transmit customer money. An e-commerce label, consulting label or company business-description code is not enough to establish the licensing position.

Break mixed operations into separate activities. Preparing food, selling it for consumption on site, delivering packaged goods and selling alcohol can raise different questions. Likewise, software supplied to a financial business is not automatically the same activity as giving investment advice or arranging transactions. The facts determine which rules need to be read.

Treat entity formation as a separate foundation. Hong Kong company registration establishes the company and its initial records, while operating permissions depend on its activities. The IRD business-registration explanation expressly separates business registration from a licence to trade. The Business Registration Certificate is not a universal operating licence.

Define the activity before choosing a licence route

Translate your business model into the activities, places and payment roles an authority needs to assess.

Build a licence routing sheet from official sources

Start with the Trade and Industry Department’s Business Licence Information Service, then follow each relevant entry to the issuing authority’s current guidance. The SUCCESS service description confirms that BLIS covers government licences, permits, certificates and approvals. Use it as an identification route; verify the specific scope and conditions at the regulator.

Trigger to investigate Official starting authority Evidence to obtain
Food preparation, sale or on-site consumption Food and Environmental Hygiene Department Correct licence or permit category and premises requirements
Business in securities-related regulated activities Securities and Futures Commission Activity classification and corporate/personnel requirements
Remittance or money-changing services Customs and Excise Department MSO licensing analysis and application conditions
Several activities or uncertain category TID Business Licence Information Service Relevant authority list, followed by direct rule checks

For every identified requirement, create a row with six fields: exact activity; licence or approval; applicant; premises or person covered; prerequisite evidence; and the event that permits launch. Add an owner and source date. This is a planning worksheet, not a government-prescribed checklist, and it should reflect the planned business rather than a list of every possible Hong Kong licence.

Use activity-specific licensing and application checks when moving from initial screening to an identified application. Do not copy a licence category from an unrelated business merely because both companies describe themselves as online traders.

Screen the premises before lease and fit-out commitments

Resolve location-sensitive requirements before signing a long lease or starting fit-out. The FEHD licensing FAQ explains that food premises must satisfy health, building and fire safety requirements, government lease conditions and statutory planning restrictions. A landlord’s willingness to rent the unit does not establish licensing suitability.

Request the premises documents needed for the identified activity and have the relevant professional assess them. Compare the intended layout and equipment with the licence requirements. Budget and scheduling decisions should distinguish a feasible premises choice from an application still awaiting inspection or remedial works. Premises feasibility is an early dependency, not a box to tick after the company is incorporated.

The decisions are easier to control when the activity, place and people reviews feed a single launch permission rather than running as disconnected tasks.

Check people, customer locations and money flows

Read corporate and individual requirements together. The SFC licensing perimeter guidance distinguishes corporations carrying on regulated activities, individuals performing regulated functions and responsible officers. It also addresses active marketing into Hong Kong from outside the territory. An overseas website or an offshore owner does not by itself close the jurisdictional question.

Map customer-money flows in plain language: who receives the funds, who owns them, who directs a transfer, and whether the business serves others as a remittance or money-changing service. The Customs MSO supervision guidance identifies the licensing requirement for those services. Routine payment for your own goods should not be equated automatically with operating a remittance business; review the actual service and applicable definitions.

For food operations, the FEHD licence-category guide distinguishes different food-business licences, restricted-food permits and liquor licensing. One operation may need more than one permission. Define the applicant and covered location in each worksheet row so a permission held by an affiliate or another outlet is not mistaken for permission for your company’s planned service.

Connect the approval dependencies

Assign the applicant, premises evidence and personnel requirements to named owners.

Resolve an uncertain requirement with a defined evidence request

When the perimeter remains uncertain, send a precise factual question to the responsible authority or a suitably qualified adviser. Attach the operating description, customer journey, funds flow, premises information and proposed applicant. Ask which factual feature triggers the requirement, which exemption is being considered, and what evidence supports the answer.

Save the response with the version of the business model it addresses. A reply about software-only services does not resolve a later change to handling client assets. If the authority asks for more detail, update that fact rather than repeatedly searching broader phrases. Keep uncertain activities outside the launch scope until the material question has been resolved.

Set the launch boundary for each licensed activity

Approve launch activity by activity. Each relevant row should identify the correct applicant, any covered premises and personnel, the permission issued or substantiated exemption, outstanding conditions and renewal owner. An application receipt establishes submission; it does not establish permission to begin a regulated activity.

Escalate before launch where the licence holder differs from the operator, premises suitability is unresolved, a required individual approval is missing, or the business model has changed since the advice. Reopen the screening whenever a new product, outlet, customer market or money-flow role changes the facts used for the original decision.

Set a documented launch boundary

Confirm which activities can start and which remain dependent on permission.

Frequently asked questions

Does an online-only business avoid all licensing checks?

No. Screen the activity, goods, customers and money flows even without customer-facing premises. The delivery channel alone does not settle the applicable regime.

Can I rely on a consultant’s “no licence required” email?

Ask for the activities and assumptions assessed, the legal basis and any limits. A short conclusion without the facts it covers is difficult to apply when the business changes.

Should fees and processing times be fixed at screening?

Identify the correct licence first. Then use the issuing authority’s current fee and processing information for that application, including prerequisites; a generic registration timeline is unsuitable.

Does incorporating before screening prevent a later licence application?

It does not by itself settle eligibility either way. Check the required applicant structure, owners, personnel and premises before assuming the chosen company can obtain the permission.
